The Studio is in a position to provide to its clients specialized
services in the following areas.
a. Employment relations
The Studio has acquired considerable experience in the labour-law
area and, in particular, in the solution of the problems arising
out of "subordinated" employment relations, quasi-subordinate
employment relations and self-employment relations.
More particularly, the Studio is in a position to provide advisory
service, opinions, as well as litigation assistance related to the
termination of employment, the defence or the opposition to disciplinary
actions, the problems arising out of the down-grading of personnel,
the transfer of employees and the temporary assignment of employees
to other locations, the contract drafting necessary for the hiring
of executive and non-executive personnel or for the amicable or
unamicable termination of employment relationships, the drafting
of warnings to employees or of letters of termination of employment
relationships, or of settlement agreements. The Studio also assists
in connection with negotiations with unions.
b. Software Protection and Internet
The Studio has acquired "in depth" knowledge of the
problems related to the protection of computer programs and internet.
In particular, it has engaged in litigation involving the improper
use and/or the copying of software programs, the breaches of software
license agreements, the violation of copyright laws and the seeking
of "urgent" measures such as restraining orders, injunctions
and seizure orders.
In the non-litigation area, the Studio has acquired considerable
experience in drafting computer contracts, such as software licenses,
software maintenance contracts, distribution agreements, outsourcing
agreements. The Studio also provides to clients advisory services
in the vast area of software protection and in connection with the
complex legal issues related to Internet.
c. Industrial Property Law
The Studio is particularly active in the area related to the protection
of trademarks and to the infringement of trademarks and the nullity
of trademarks, as well as in the area of litigation available under
the Trademark Laws, including "urgent" measures, such
as restraining orders, injunctions and seizures). In such connection
the Studio offers advisory and contract drafting assistance also
taking into account anti-trust and EU legal requirements.
d. Competition Law
The Studio has also acquired considerable experience in the competition
law area, it having been involved with both the "urgent"
measure aspects as well as the "merit" aspects of unfair
competition litigation and, in particular, with legal actions regarding
the confusing use of names or of distinctive devices, product denigration,
confusion with the business of competitors, defamation of competing
products or of the business of competitors, misappropriation of
the "praising" claims of competitors, copying of products,
the stealing of employees, "on line" unfair competition
and deceiving advertising.
In the above connections the Studio also renders advisory, litigation
and contract drafting services, taking into due consideration the
basic principles of antitrust and EU laws related to competition
which come into play.
e. Commercial Law
The Studio is further concerned with the problem areas generally
related to trade and business, including those which require litigation
to collect accounts receivables, insolvency and bankruptcy, contract
drafting and specifically general conditions of sale, the issue
of guarantees, distribution, joint venture and other commercial
relationships.
